Terms of Service

1. Introduction

Welcome to Digital Dashboard Hub ("DDH," "we," "us," or "our"), operated by Andy Gaber as a sole proprietorship. These Terms of Service ("Terms") govern your access to and use of the Digital Dashboard Hub website located at digitaldashboardhub.com and all related services, tools, and applications (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Account Terms

To access the Service, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. You must provide accurate and complete information when creating your account and keep that information current.

You may not share your account with others, use another person's account without permission, or create multiple accounts to abuse free trials or promotional offers. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

Digital Dashboard Hub is a software-as-a-service (SaaS) platform that provides access to 240+ interactive HTML dashboard tools organized across categories including personal finance, productivity and ADHD management, and health and wellness tracking. The specific tools available depend on your subscription tier.

4. Free Trial

We offer a 14-day free trial that requires only an email address to activate. No credit card is required for the trial. During the trial period, you will have access to a selection of tools as determined by us.

At the end of the trial period, your access to paid features will be suspended until you subscribe to a paid plan. Any data you saved during the trial will be retained for 90 days, after which it may be permanently deleted.

5. Subscription, Billing, and Refunds

Plans and Pricing

We offer monthly plans at $9, $19, and $49 per month; annual plans at $90, $190, and $490 per year; and a one-time Lifetime Deal at $199. Prices are in US dollars and may be subject to applicable taxes. We reserve the right to change pricing with 30 days' notice to existing subscribers.

Billing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis according to your selected plan. Monthly subscriptions renew each month on your billing date; annual subscriptions renew each year. The Lifetime Deal is a single, non-recurring payment.

Plan Changes

You may upgrade or downgrade your plan at any time through your account settings. Upgrades take effect immediately, and you will be charged a prorated amount. Downgrades take effect at the start of your next billing cycle.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to your paid features until the end of your current billing period. No partial refunds are provided for unused time within a billing period.

Refunds

We offer a 30-day money-back guarantee on all new subscriptions. If you are not satisfied within the first 30 days after your initial payment, contact us at support@digitaldashboardhub.com for a full refund. After 30 days, refunds are issued at our sole discretion. The Lifetime Deal is also eligible for the 30-day money-back guarantee.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or extract the source code of our tools
• Scrape, copy, reproduce, or redistribute any dashboard tools or content from the Service
• Share, resell, or sublicense your account access to third parties
• Use automated systems (bots, scrapers, crawlers) to access the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to other users' accounts or data
• Upload or transmit malicious code, viruses, or harmful content
• Use the Service to compete directly with Digital Dashboard Hub
• Abuse free trial offers by creating multiple accounts

We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these acceptable use terms.

7. Intellectual Property

All content, tools, designs, code, graphics, logos, and other materials available through the Service are owned by Digital Dashboard Hub and are protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the tools for personal, non-commercial purposes during the term of your subscription.

You retain ownership of any data you input into the tools. However, you grant us a limited license to store, process, and display that data solely to provide the Service to you.

8. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Data Retention

If your subscription expires or is canceled, we will retain your account data (including saved tool data, preferences, and profile information) for 90 days. During this retention period, you may reactivate your subscription and regain access to your data. After 90 days, your data may be permanently deleted and cannot be recovered.

You may request deletion of your data at any time by contacting us. We will process data deletion requests within 30 days, subject to any legal obligations requiring us to retain certain records.

10. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

We reserve the right to modify, update, add, or remove tools and features at any time without prior notice. We do not guarantee that any specific tool will always be available.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.

The dashboard tools are for informational and personal tracking purposes only. They do not constitute professional financial, medical, psychological, or legal advice. You should consult qualified professionals before making decisions based on information from the tools.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Digital Dashboard Hub and its owner, Andy Gaber, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Digital Dashboard Hub and its owner from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. We may suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or extended inactivity.

Upon termination, your right to access the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall survive.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
